Work Order - Terms & Conditions

1. General

1.1 These Terms & Conditions apply to all work performed for the strata company ("Principal") when engaged through a work order issued by XO Strata ("Agent").

1.2 Acceptance of the work order, commencement of work, or delivery of goods is deemed acceptance of these Terms & Conditions.

2. Contractor Responsibilities

2.1 The Contractor must carry out all work with due skill, care, diligence and in accordance with all applicable laws, regulations, Australian Standards and industry best practice.

2.2 The Contractor must supply all necessary labour, materials, tools and equipment unless otherwise agreed in writing.

2.3 The Contractor is responsible for the conduct, actions and safety of all personnel engaged in the works.

3. Licensing & Insurance

3.1 The Contractor must hold all licences, registrations and permits required for the work being performed.

3.2 The Contractor must maintain current and adequate insurance, including:

  • Public Liability ($10M minimum or as specified)

  • Workers Compensation (where required)

  • Any other insurance relevant to the scope of work.

3.3 Certificates of currency must be provided upon request.

 

4. Health & Safety

4.1 The Contractor must comply with all Work Health & Safety obligations under WA legislation.

4.2 Before commencing work, the Contractor must assess and manage any risks to occupants, visitors and property.

4.3 Unsafe work areas, hazards or risks must be promptly reported to the Agent.

 

5. Access & Site Conditions

5.1 The Contractor must liaise with the Agent to arrange access and confirm any site-specific requirements.

5.2 The Contractor must ensure the work area is left clean, tidy and safe after completion.

5.3 Damage to common property, lots or belongings caused by the Contractor must be repaired at the Contractor's cost.

 

6. Variations & Additional Costs

6.1 Any variation to the quoted or authorised work-whether due to unforeseen conditions, additional works requested, or cost changes-must be approved in writing by the Agent before proceeding.

6.2 The Principal will not be liable for unapproved additional work or costs.

 

7. Timeframes

7.1 The Contractor must complete the work within the timeframe specified in the work order, or otherwise advise the Agent of any expected delays.

7.2 Emergency or urgent works must be attended within the timeframe specified by the Agent.

 

8. Invoicing & Payment

8.1 Invoices must:

  • Reference the work order number

  • Itemise labour, materials and GST

  • Describe the work completed.

8.2 Payment terms are strictly 30 days from receipt of a valid invoice, unless otherwise agreed.

8.3 The Contractor acknowledges the Principal's responsibility to comply with trust accounting and legislative requirements for strata schemes, which may affect payment timing.

 

9. Warranty & Defects

9.1 The Contractor warrants that all work and materials will be free from defects and fit for purpose.

9.2 Any defects identified must be rectified promptly at the Contractor's cost.

9.3 Statutory warranties and consumer guarantees apply.

10. Confidentiality & Privacy

10.1 The Contractor must keep confidential any information obtained in the course of providing services.

10.2 Personal information of owners or residents must not be collected, stored or used except as necessary to complete the works.

11. Termination

11.1 The Principal or Agent may cancel the work order at any time prior to commencement without cost.

11.2 If work has commenced, the Principal will pay the Contractor for work completed up to the cancellation date, provided that work is substantiated and authorised.

12. Dispute Resolution

12.1 Any dispute between the parties should first be raised with the Agent for resolution.

12.2 If unresolved, the matter may be escalated through appropriate legal or statutory mechanisms.

 

13. Priority of Documents

13.1 These Terms & Conditions apply unless otherwise overwritten by written agreement, contract or a specific arrangement authorised by the Agent.
